New regulations on electronic identification and authentication

Recently, the government issued Decree No. 59/2022/ND-CP dated September 5, 2022, providing for electronic identification and authentication.
Accordingly, the subjects granted electronic identification accounts include: (1) Vietnamese citizens aged full 14 years or older; for Vietnamese citizens who are under 14 years old or are guardians registered under the electronic identity accounts of their parents or guardians; (2) Foreigners aged full 14 years or older entering Vietnam; for foreigners who are under 14 years old or are guardians registered under the electronic identity accounts of their parents or guardians; (3) Agencies and organizations established or registered to operate in Vietnam.
There are four levels of e-ID account authentication as follows:
Level 1: Authentication of electronic identity accounts is performed based on an authentication factor specified in Clause 9 Article 3 and an authentication means specified in Clause 10, Article 3 of this Decree in which no biometric information is available.
Level 2: Authentication of electronic identity accounts is performed based on two different authentication factors as prescribed in Clause 9 Article 3 and the corresponding authentication means in Clause 10, Article 3 of this Decree. There is no biometric information.
Level 3: Authentication of electronic identity accounts is performed based on two or more different authentication factors as prescribed in Clause 9 Article 3 and corresponding authentication means in Clause 10, Article 3 of the Decree, including biometric information.
Level 4: Authentication of electronic identity accounts is performed based on authentication factors including portrait photos, fingerprints with information on the Citizen Identity Card or the Citizen Identity Database, and a national database on immigration.
This Decree takes effect from October 20, 2022. Accounts used by the national public service portal, the information system for settling administrative procedures at ministerial and provincial levels, are used to perform administrative procedures and public administrative services in the electronic environment until July 1, 2024.Related news
